These Terms and Conditions (“Terms”) govern the use of the website located at alpharettabeacon.com and the purchase of products and services from Alpharetta Beacon Consulting LLC, doing business through the Alpharetta Beacon website and brand presentation (“Alpharetta Beacon,” “Company,” “we,” “us,” or “our”).

Our principal office is located at 5745 Stables Way, Unit A09, Alpharetta, GA 30004.

By using our website, requesting a quotation or sample, submitting specifications, approving a proposal, issuing a purchase order, paying an invoice or deposit, or otherwise purchasing products or services from us, you agree to these Terms together with any applicable quotation, proposal, order confirmation, invoice, specification sheet, or written agreement.

1. Our Business

Alpharetta Beacon provides custom corporate textiles, neckwear, scarves, uniform accessories, textile development, sampling, sourcing, production coordination, quality-control support, and related fulfillment services for business and institutional customers.

Our products may be manufactured or produced according to customer-supplied artwork, colors, specifications, dimensions, materials, branding requirements, quantities, and other project requirements.

Because many of our products are made specifically for an individual customer, additional terms applicable to custom products are described below.

2. Quotations and Proposals

All quotations and proposals are based on the specifications, quantities, materials, artwork, delivery requirements, and other information available when the quotation is prepared.

Unless otherwise stated in writing:

  • quotations are estimates until formally accepted by Alpharetta Beacon;

  • pricing may change if the customer changes quantities, materials, dimensions, artwork, packaging, delivery requirements, or other specifications;

  • freight, shipping, duties, taxes, expedited services, special packaging, and similar charges may be quoted separately;

  • production availability and lead times are subject to confirmation; and

  • a quotation does not reserve production capacity until an order is accepted.

Where a quotation, proposal, purchase agreement, or order confirmation contains terms that expressly differ from these Terms, the specific written order terms will control for that transaction.

3. Orders and Acceptance

Submitting a purchase order or making a payment does not necessarily constitute final acceptance of an order.

An order becomes binding when Alpharetta Beacon confirms acceptance in writing or otherwise begins performing the agreed work.

We may decline an order before acceptance due to production availability, material availability, credit considerations, regulatory concerns, incomplete information, or other legitimate business reasons.

4. Custom Product Development

Custom orders may involve one or more stages including:

  1. consultation and specification review;

  2. artwork or pattern development;

  3. Pantone-referenced color development;

  4. material selection;

  5. digital or physical samples;

  6. strike-off or prototype review;

  7. customer approval;

  8. production;

  9. quality review; and

  10. packaging and delivery.

The exact process depends on the product and project requirements.

5. Samples, Strike-Offs and Approvals

Where applicable, Alpharetta Beacon may provide digital artwork, yarn references, swatches, strike-offs, prototypes, pre-production samples, or similar approval materials.

Customers are responsible for carefully reviewing all approval materials, including:

  • colors;

  • logos;

  • spelling;

  • dimensions;

  • proportions;

  • pattern placement;

  • material;

  • construction;

  • finishing;

  • labeling; and

  • other specifications.

Production may begin once written approval is received.

Customer approval authorizes Alpharetta Beacon to proceed substantially in accordance with the approved specifications.

Changes requested after approval may result in additional charges, revised production schedules, or both.

6. Color and Manufacturing Tolerances

Textile manufacturing involves natural and technical variation.

Pantone references and other color standards are used as production targets; however, appearance may vary due to fibers, yarn composition, dye lots, weaving or printing techniques, finishes, lighting conditions, display screens, and other manufacturing factors.

Accordingly, exact visual identity between a digital representation, Pantone guide, sample, and finished textile cannot always be guaranteed.

Reasonable commercial variation may also occur in:

  • dimensions;

  • color;

  • weave;

  • print placement;

  • stitching;

  • fabric texture;

  • weight;

  • finishing;

  • pattern alignment; and

  • individual pieces within a production run.

A reasonable manufacturing variation that does not materially impair the intended use of the product will not, by itself, constitute a defect.

Approved physical samples or written specifications will be the primary reference for determining conformity whenever applicable.

7. Customer Artwork and Intellectual Property

Customers may provide names, logos, trademarks, artwork, designs, emblems, crests, photographs, graphics, specifications, or other materials for incorporation into custom products.

By providing such materials, the customer represents and warrants that it:

  • owns the materials or has permission to use them;

  • has the authority to authorize their reproduction;

  • is not infringing the rights of another person or organization; and

  • has obtained any necessary trademark, copyright, licensing, or other approvals.

The customer grants Alpharetta Beacon a limited right to use the supplied materials solely as reasonably necessary to develop, manufacture, source, produce, package, or fulfill the customer's order.

We may refuse to reproduce materials that we reasonably believe may violate applicable law or third-party rights.

8. Pricing and Payment

Payment requirements will be stated in the applicable quotation, proposal, invoice, or order confirmation.

Depending on the project, we may require:

  • payment for sampling or development;

  • a deposit before production;

  • progress payments;

  • payment before shipment; or

  • other mutually agreed payment terms.

Customers agree to pay all amounts properly invoiced according to the stated due dates.

Taxes, shipping charges, duties, customs charges, bank fees, or similar amounts may be added where applicable and disclosed through the applicable transaction documents.

9. Payment Processing

Payments may be processed through banks, merchant service providers, invoicing platforms, ACH providers, card processors, or other third-party payment providers.

Those providers may have separate terms and privacy practices governing their services.

Customers may not knowingly submit unauthorized payment information or use a payment method without the account holder's permission.

If a customer believes a charge is incorrect, we encourage the customer to contact Alpharetta Beacon promptly so that the transaction can be investigated.

10. Order Changes

Requests to change an order should be submitted in writing.

We will make reasonable efforts to accommodate changes before production begins, but we cannot guarantee that a requested modification can be made.

Changes may result in:

  • additional development costs;

  • material costs;

  • restocking or supplier costs;

  • revised unit pricing;

  • additional sampling;

  • production delays; or

  • revised shipping dates.

No change is binding until confirmed by us.

11. Cancellations

Because custom products may be developed or produced specifically for a particular customer, cancellation rights depend on the stage of the project.

Before production begins, a customer may request cancellation. Any refund will be reduced by nonrecoverable costs already incurred, including approved design work, samples, custom materials, supplier charges, or other project-specific costs.

After custom materials have been committed, final approval has been given, or production has begun, an order may be non-cancellable or only partially refundable.

The applicable quotation or order confirmation may contain more specific cancellation provisions.

12. Production and Lead Times

Production and delivery dates are estimates unless we expressly agree in writing that a date is guaranteed.

Lead times may depend on:

  • quantity;

  • product complexity;

  • sample approvals;

  • material availability;

  • customer revisions;

  • production scheduling;

  • carrier availability;

  • customs processing;

  • destination; and

  • events outside our reasonable control.

Production schedules generally begin after all required approvals, specifications, and payments have been received.

We will communicate material changes to an anticipated schedule when reasonably practicable.

13. Shipping and Delivery

Shipping method, destination, freight charges, and other delivery requirements may be specified in the applicable quotation or order confirmation.

Customers are responsible for providing complete and accurate delivery information.

We are not responsible for delays attributable solely to carriers, customs authorities, inaccurate customer information, import restrictions, or other events outside our reasonable control.

Where shipments arrive visibly damaged, the customer should document the condition of the shipment and contact us promptly.

14. Inspection of Products

Customers should inspect delivered products promptly.

If a customer believes an order is defective, damaged, incorrect, or materially inconsistent with the approved specifications, the customer should contact us within 10 business days after delivery, where reasonably possible.

The notice should include:

  • order or invoice information;

  • description of the issue;

  • quantity affected; and

  • photographs or other documentation reasonably necessary to evaluate the issue.

Customers should retain affected products until the claim has been reviewed.

15. Custom Product Returns

Custom, personalized, logo-bearing, specially manufactured, or made-to-order goods generally cannot be returned simply because the customer changes its mind.

This restriction does not eliminate remedies for products that are confirmed to be defective, incorrectly produced, damaged before transfer, or materially inconsistent with approved specifications.

16. Defective or Nonconforming Products

If we confirm that products contain a material manufacturing defect or materially fail to conform to agreed specifications, Alpharetta Beacon may, as appropriate:

  • repair the affected products;

  • replace the affected products;

  • reproduce the affected portion of the order;

  • issue an appropriate credit;

  • provide an appropriate partial refund; or

  • provide another commercially reasonable remedy agreed with the customer.

The appropriate remedy will depend on the nature and scope of the issue.

Normal manufacturing tolerances described in these Terms are not considered defects.

17. Care and Product Performance

Product lifespan and appearance depend on usage, laundering, cleaning methods, storage conditions, environmental exposure, and other factors outside our control.

Customers should follow any care instructions supplied with the applicable product.

Claims regarding stain resistance, colorfastness, wash performance, breakaway features, durability, or other technical characteristics apply only where expressly stated for the specific product or specification.

18. Website Content

We endeavor to keep our website accurate and current, but website information is provided for general informational purposes and may be updated from time to time.

Website photographs, renderings, diagrams, colors, samples, descriptions, and product examples are illustrative unless expressly incorporated into a written order specification.

Nothing on the website constitutes a guaranteed quotation, production commitment, warranty, or technical specification unless confirmed in writing for a particular order.

19. Website Intellectual Property

Unless otherwise stated, the website and its original text, graphics, layouts, photographs, branding, and other content are owned by or licensed to Alpharetta Beacon Consulting LLC.

You may view and use the website for legitimate business and informational purposes.

You may not, without permission:

  • reproduce substantial portions of the website;

  • commercially exploit website content;

  • misrepresent our branding or materials as your own;

  • use our trademarks in a misleading manner; or

  • interfere with the website's operation or security.

20. Third-Party Websites and Services

Our website or communications may contain links to third-party services.

We are not responsible for the content, availability, policies, security, or practices of websites and services we do not control.

21. Disclaimer of Warranties

Except for warranties expressly provided in a written quotation, specification, order confirmation, or other agreement, and to the fullest extent permitted by applicable law, products and services are provided without additional implied guarantees beyond those that cannot lawfully be excluded.

Nothing in these Terms excludes rights or warranties that applicable law does not permit the parties to waive.

22. Limitation of Liability

To the maximum extent permitted by law, Alpharetta Beacon Consulting LLC will not be liable for indirect, incidental, consequential, exemplary, or special damages arising from an order or use of this website, including lost profits or lost business opportunities.

Except where applicable law requires otherwise, our aggregate liability arising from a particular product order will not exceed the amount actually paid to Alpharetta Beacon for the portion of the order giving rise to the claim.

Nothing in these Terms limits liability where limitation is prohibited by law.

23. Force Majeure

Neither party will be responsible for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, severe weather, war, terrorism, civil disturbance, labor disruptions, transportation interruptions, power or telecommunications failures, government action, epidemics, pandemics, supplier disruptions, port closures, customs delays, or shortages of necessary materials.

The affected party will make commercially reasonable efforts to minimize the impact of such circumstances.

24. Compliance With Law

Each party is responsible for complying with laws and regulations applicable to its own activities under a transaction.

Customers are responsible for any industry-specific uniform, labeling, safety, import, export, procurement, or regulatory requirements that they have not specifically asked Alpharetta Beacon to assume in writing.

25. Privacy

Our collection and handling of personal information through the website is described in our Privacy Policy.

26. Governing Law

These Terms and transactions governed by them will be governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Unless otherwise agreed in writing, disputes that cannot be resolved informally may be brought in courts having appropriate jurisdiction in or serving Fulton County, Georgia.

27. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

28. No Waiver

Failure to enforce a provision of these Terms does not waive the right to enforce that provision later.

29. Updates to These Terms

We may update these Terms from time to time.

The current version will be posted on this page with an updated effective or revision date. Changes will apply prospectively unless otherwise required by law.
